1.1 Definitions

- Consumer: natural person within the meaning of § 13 BGB
1.2 Scope
These General Terms and Conditions apply to all contractual relationships between MPU-Akademie and consumers.
1.3 Precedence of the T&Cs
Contracts are concluded exclusively in accordance with these T&Cs unless deviating individual agreements have been made.
2. Content of the contract
2.1 Description of services
MPU-Akademie prepares the client online for the MPU. The counselling comprises individually tailored traffic-psychology MPU preparation, including the provision of preparation materials.
The online sessions take place via Zoom or Google Meet and are conducted by qualified traffic-psychology and medical professionals in the field of MPU preparation.
2.2 Scope of counselling (MPU packages)
- Basis package: 6 one-to-one sessions of 50 minutes each and 1 mock MPU
- Premium package: 9 one-to-one sessions of 50 minutes each and 1 mock MPU
- Premium Plus package: unlimited one-to-one sessions and one or more mock MPUs
Individual agreements are made separately and recorded in the invoice.
2.3 Coordination
The counselling takes place in close coordination between MPU-Akademie and the client.
2.4 No guaranteed result
Comprehensive counselling is owed, but not any specific result or passing the MPU.
3. Registration and conclusion of the contract
3.1 Booking
The prerequisite for using the services is booking MPU preparation.
3.2 Conclusion of the contract
- Completion of the online booking
- Payment of the invoice
- Separate written payment agreement
3.3 Confirmation and scheduling
After receipt of the booking, the client receives a booking confirmation by email.
Booking does not yet fix a counselling appointment.

4. Client's duties to cooperate
The client's active cooperation is an essential prerequisite for achieving the aim of the counselling.
5. Prices and terms of payment
5.1 Prices
The final prices shown in the offer, including statutory VAT, apply.
5.2 Due date
The counselling fee must be paid in advance.
5.3 Payment methods

5.4 Invoicing
Invoices are issued exclusively digitally by email.
6. Term and termination of the contract
6.1 Maximum counselling period
The MPU counselling must be completed within 24 months of conclusion of the contract. After this period there is no entitlement to further counselling services.
6a. Direct booking and direct-booker protection module
6a.1 Scope
The following provisions apply exclusively to bookings that are concluded and paid for directly via the MPU-Akademie website.
If an information or initial consultation takes place before the booking, the additional cancellation right set out in this section does not apply.
6a.2 Direct booking
A direct booking exists when the client books and pays for a preparation package via the MPU-Akademie website without a personal information or initial consultation having taken place beforehand.
6a.3 Additional cancellation right after the first session
In addition to the statutory right of withdrawal, MPU-Akademie grants a voluntary, contractually agreed additional cancellation right for direct bookings.
The client may withdraw from the contract up to 48 hours after the end of the first traffic-psychology one-to-one session at the latest.
In this case, the total amount paid is refunded in full. No deduction is made for the session already held.
6a.4 Conditions for the additional cancellation right
- The first traffic-psychology one-to-one session has already taken place.
- The cancellation is declared within the period stated in section 6a.3.
- No further sessions or services beyond the first session have been used.
6a.5 Form of cancellation
The cancellation must be declared to MPU-Akademie in text form, for example by email. The time of receipt of the declaration of cancellation is decisive for meeting the deadline.
6a.6 Distinction from the statutory right of withdrawal
The additional cancellation right set out in this section exists independently of the statutory right of withdrawal and does not affect it.
6a.7 No guaranteed result
Irrespective of the additional cancellation right, no specific result, in particular no positive result of an MPU assessment, is owed or guaranteed.
7. Liability
No guarantee or assurance is given that the MPU will be passed.

9. Confidentiality
All information from the counselling is subject to statutory confidentiality under § 203 StGB.
10. Information on the right of withdrawal
Consumers have the right to withdraw from this contract within fourteen days without giving reasons.
The withdrawal period is fourteen days from the day the contract is concluded.
To exercise the right of withdrawal, the client must inform MPU-Akademie, represented by Gunnar Hoyer, Stadthof 16a, 63065 Offenbach am Main, email: info@mpu-akademie.eu, of their decision to withdraw from this contract by means of a clear statement (for example by email or letter).
To meet the withdrawal deadline, it is sufficient to send the notice of exercise of the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal
If this contract is withdrawn from, all payments made by the client will be refunded without undue delay and at the latest within fourteen days from the day on which notice of withdrawal from this contract was received.
The same means of payment that was used for the original transaction will be used for this refund, unless expressly agreed otherwise. In no case will any fees be charged for this refund.
If the client has requested that the services begin during the withdrawal period and counselling services are already used within the withdrawal period, a flat-rate amount of 150 euros is payable for each counselling session already used.
11. Cancellation of appointments
For appointments that are not cancelled at least 24 hours in advance, a reservation fee of 139 euros is charged or one session is deducted from the booked allowance.
